The problem

Every brand that uses music is in the music business. Licensed or not.

The music libraries in Instagram and TikTok are licensed for personal use. Brands draw on the same libraries for advertising, product videos and corporate social channels, and rarely clear the recording for that purpose.

For rights owners these uses are close to invisible: spread across thousands of accounts, live for days, and never reported.

Legal context

The courts have drawn the line.

Platform libraries do not cover brands

In 2022, Sony Music and Universal obtained liability rulings against Bang Energy: a platform's general music library did not cover the company's own promotional videos.Sony Music and UMG v. Vital Pharmaceuticals (Bang Energy), 2022

Major labels are enforcing

In 2025, Warner Music Group brought proceedings against Crumbl concerning at least 159 recordings used in the brand's social content.Warner Music Group v. Crumbl, 2025

The cleared catalogue is narrow

TikTok's Commercial Music Library contains around 600,000 pre-cleared tracks; streaming services carry more than 250 million.TikTok; Luminate

Commercial music in brand content is common

An analysis of more than 19,000 TikTok posts from ten beauty brands found commercial music in 30% of them. These are matches, not confirmed infringements, which is why each use is verified individually.Pex analysis
